Custody & Parenting Time Evaluations
Custody and parenting time evaluations are another useful form of alternative dispute resolution available to parties and families struggling to resolve their differences. These evaluations consist of a neutral process where the evaluator takes the time to meet with the parties and the children, speak with collaterals, and obtain relevant documentation for a full scope analysis of the twelve (12) statutory best interest factors required to determine issues of parenting time, parenting plans, and custody. This process can take several months and sometimes includes requests for additional assessments by the parties and/or children to obtain more data for a comprehensive review. Evaluation results can be provided through oral reports, written reports or testimony in court. Families who rely on custody evaluations have a greater likelihood of settlement.
To get started, the parties must first obtain an agreed-upon court order assigning the evaluator to the matter and specifying the issues for evaluation.
We will work with you, the other party and/or involved attorney(s) to draft an order to initiate the evaluation.

A Custody and Parenting Time Evaluation can be beneficial for:
Parents in High-Conflict Cases
When parents strongly disagree on custody, parenting time, or decision-making responsibilities, an evaluation provides an objective assessment to guide the court.
Parents Concerned About the Child’s Well-Being
If one parent believes the other’s home environment, lifestyle, or parenting style is detrimental to the child, an evaluation can assess the situation.
Cases Involving Allegations of Abuse or Neglect
When there are claims of domestic violence, substance abuse, neglect, or emotional harm, an evaluator can investigate and make recommendations in the child’s best interest.
Parents Seeking a Change in Custody or Parenting Time
If circumstances have changed significantly since the original divorce custody of parenting time order (e.g., relocation, remarriage, a parent’s instability), an evaluation can help determine if a modification is in the best interests of the child.
Judges and Courts
Courts benefit from evaluations as they provide professional insight into what custody and parenting plan would best serve the child’s needs.
Children
The primary focus of the evaluation is the child’s best interest, ensuring they have a safe, stable, and supportive living arrangement.
